Freedom of AssociationHistoryThe constitution of 1994 of Tajikistan recognizes the freedom of association in Article 28 and is cited to ‘correspond to democratic norms’. Article 8 of the constitution states citizens may form associations that only function and exist within the framework of the constitution.

Freedom of ExpressionHistoryArticle 30 of Tajikistan’s constitution guarantees freedom of speech and prohibits state censorship, while Article 40 guarantees the right to freely create. The document was first adopted in 1994; however, as citizens of a Soviet Republic in the 1980s, the people of Tajikistan were granted some freedom of expression as a result of Mikhail Gorbachev’s glasnost (“openness”) and perestroika (“restructuring”) policies prior to independence.

Freedom of ReligionHistoryThe first assertion of the freedom of religion in Tajikistan is the 1994 Constitution post-independence from the Soviet Union. The right is found in article 26 which allows the individual, or group to adhere to any religion or none. An amendment to current law (enforced in January 2018) permits restrictions on religious activity for the sole purpose of ensuring the rights and freedoms of others, as well as banning one religious sect from being state ideology (U.S. Department of State, "2018 Report on International Religious Freedom: Tajikistan").
Freedom of the PressHistoryArticle 30 of Tajikistan’s 1994 Constitution protects press freedom: “Everyone is guaranteed freedom of speech, press, [and] the right to use means of mass information" (Constitute Project, “Tajikistan’s Constitution of 1994 with Amendments through 2016” ).
Privacy RightsHistoryArticles 22 and 23 of the 1994 Tajikistan constitution protect the right to privacy. Voting Rights and SuffrageHistoryUnder Articles 49 and 65, members of the Majlisi Namoyandagon and the President of Tajikistan are elected in universal and free elections by secret ballot.
